The national securities and business litigation law firm, Levin Law, P.A. (“Levin Law”) is proud to announce the following case results on behalf of clients in Florida, Michigan, and Mexico City. Managing partner Brian Levin represents investors and shareholders who have been the victim of stockbroker misconduct, investment fraud, and shareholder oppression. Below is a list of recent recoveries obtained on behalf of Levin Law clients.
Brian Levin recovered $11 million for a minority shareholder in a Michigan company who alleged that a controlling shareholder in a privately held company engaged in shareholder oppression. The controlling shareholder in the company paid himself millions in stock redemptions on terms not offered to the minority shareholder. The defendant also refused to declare dividends for years, even though the company had the ability to pay dividends. Shareholder oppression can involve any improper or inappropriate conduct used by a majority shareholder to the detriment of a minority shareholder.
A $275,000 recovery was received from a brokerage firm that churned a customer’s securities accounts. Churning occurs when a stockbroker engages in excessive trading for the primary purpose of generating commissions instead of what is in the best interest of the client. Churning is unsuitable for customers and can result in substantial losses to an investor.
Attorney Brian Levin obtained a $175,000 recovery on behalf of an international holding company from a European bank that misrepresented the risks of a structured note. Stockbrokers, investment advisors, and financial institutions have a duty to fully disclose all material risks to an individual or institutional investor.
